Terms of Service

1. Acceptance of Terms

By accessing or using StewardMAX ("the Service"), operated by StewardMAX LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms apply to all users, including ministry administrators, staff, and members.

2. Description of Service

StewardMAX is a cloud-based ministry management platform that provides tools for people management, giving, worship planning, website building, accounting, communications, social media scheduling, background checks, and AI-powered features for churches and faith-based organizations.

3. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.

You must be at least 18 years old to create an administrative account. Member accounts for minors may only be created by a ministry administrator on their behalf.

4. Subscription Plans and Billing

StewardMAX offers several subscription tiers. By selecting a paid plan, you authorize us to charge your payment method on a recurring basis. Subscription fees are billed in advance and are non-refundable except as required by law or as described in our refund policy.

We reserve the right to change pricing with at least 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any regulations
  • Upload or transmit harmful, offensive, or fraudulent content
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure
  • Resell, sublicense, or redistribute access to the Service without written permission
  • Use automated tools to scrape or extract data from the Service
  • Interfere with the proper functioning of the Service
  • Publish content through StewardScheduler that violates any third-party platform's terms of service
  • Use AI-assisted features to generate content that is deceptive, defamatory, or violates applicable law

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You retain ownership of all data you input into the Service. We process your data only as necessary to provide the Service and as described in our Privacy Policy.

You are responsible for ensuring that you have appropriate authorization to upload any personal data about your congregation members and that your use complies with applicable privacy laws.

7. Social Media Scheduling (StewardScheduler)

StewardScheduler allows your ministry to connect and publish to social media platforms including Facebook, Instagram, X (Twitter), Threads, TikTok, and others. By using StewardScheduler, you agree that:

  • You have the authority to connect the social media accounts you link to the Service and to authorize StewardMAX to publish content on your behalf
  • You are solely responsible for all content published through connected accounts, including compliance with each platform's terms of service, community standards, and applicable laws
  • StewardMAX is not liable for any account suspension, content removal, or penalties imposed by third-party social media platforms
  • You may disconnect any social account at any time; upon disconnection we will cease publishing and remove stored access tokens for that account

8. Background Checks

StewardMAX integrates with Checkr, Inc. to facilitate background checks for staff and volunteers. By initiating a background check through the platform, you agree that:

  • You have a permissible purpose under the Fair Credit Reporting Act (FCRA) and applicable state law to request a background check on the individual
  • You will obtain any legally required consent from the individual before initiating a check
  • Checkr's own terms of service and privacy policy govern the background check process
  • StewardMAX is not a consumer reporting agency and is not responsible for the accuracy of background check results provided by Checkr

9. AI-Powered Features

StewardMAX includes AI-assisted features powered by third-party AI providers including Anthropic (Claude). By using these features, you acknowledge that:

  • AI-generated content is provided "as is" and may contain errors, inaccuracies, or omissions. You are responsible for reviewing and verifying all AI-generated content before use
  • AI features should not be relied upon as the sole basis for financial, legal, pastoral, or other consequential decisions
  • Inputs you provide to AI features may be processed by third-party AI providers subject to their own data usage policies

10. Intellectual Property

The Service and its original content, features, and functionality are owned by StewardMAX LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written consent.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may cancel your account at any time from your account settings. Upon termination, your access to the Service will cease. We will retain your data for 90 days after termination to allow for data export before permanent deletion.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Your use of the Service is at your sole risk.

13. Limitation of Liability

To the maximum extent permitted by law, StewardMAX LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising from use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

14. Governing Law

These Terms shall be governed by the laws of the State of Georgia and the United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, with proceedings conducted in Georgia.

15. Changes to Terms

We may update these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after the effective date of any changes constitutes acceptance of the new Terms.
